Recently Settled Cases

$2.8 million settlementclass action - Johnson, et al. v. Texaco, Inc. , case involving underpayment of royalty payments on natural gas and gas substances; settlement represented $1.6 million paid to class members for past royalty payments, plus future relief in the form of deductions from future cost of treatment of gas;

Confidential Settlement - medical malpractice - Settlement after mediation.   Kenneth Howard died of complications arising from a heart attack several weeks after he presented to a local Hospital’s Emergency Department and Chest Pain Center.   The emergency department performed triage on Mr. Howard within minutes of his arrival, and noted that his chief complaint was “chest pain”.   However, he was sent to the waiting room and was neither seen by the emergency physician nor placed on an EKG for almost two hours.  When he was finally placed on the EKG, the reading indicated an “acute MI” (heart attack).  Experts employed by Mr. Howard’s Estate determined that the damage caused to Mr. Howard’s heart muscle because of the delay ultimately resulted in his death.   The Hospital’s experts contended that Mr. Howard seemed to be suffering from mere indigestion, and that his death was more likely caused by an adverse reaction to the heart/lung machine used during his emergency by-pass surgery.

Confidential pro tanto settlement - law enforcement officer unintentionally discharged Glock pistol killing plaintiff during routine traffic stop; remaining product liability case against Glock manufacturer is pending;

Confidential settlement - wrongful death - infant died due to heat-related injuries received after being left in a daycare van; this was a policy-limits settlement made under defendant’s automobile and the general liability insurance policies;

Confidential settlement - breach of contract - dispute arising as to terms of previous agreement between plaintiff and the Archdiocese of Mobile;

$225,000 settlementpersonal injury  - case involved severe injury to plaintiff’s dominant hand after being asked to assist in the loading of a newly purchased appliance;

$50,000 jury verdict - car accident - plaintiff suffered back injury after being hit from rear while attempting to make lefthand turn.
